1. Who we are
Lutristy ("we", "us") operates this store and website at lutristy.com, including all related products and services. Our registered address is 5 Albert Road, Bristol BS2 0YB, United Kingdom. You can contact us at help@lutristy.com. These Terms of Service ("Terms") apply to all purchases made from lutristy.com and are read together with our Returns and Refunds Policy, Shipping Policy and Privacy Policy. By completing a purchase you agree to these Terms.
2. Orders and payment
Provide accurate order and delivery details and use a payment method you are authorised to use. Before paying, check the product, quantity, currency, shipping charge and total shown at checkout. Prices are in US dollars. Payment is processed through Shopify Payments; your order is confirmed by the confirmation email sent to you after payment.
If an item becomes unavailable or an error affects your order, we will contact you and resolve it, including a refund of any payment where the order is cancelled. We may decline or cancel an order where we suspect fraud, where a price is manifestly wrong, or where payment is not completed.
3. LTY Prime membership
Enrolment. By completing a purchase at lutristy.com you also enrol in the LTY Prime membership ("LTY Prime"). Enrolment is part of completing the purchase: the membership item is included in the order automatically.
Introductory period. LTY Prime is provided free of charge for the first 14 days after your order is confirmed (the "Introductory Period").
Renewals. After the Introductory Period, LTY Prime renews automatically at US$39.99 per 30-day period (each a "Paid Period") until you cancel. The first renewal charge is made approximately 14 days after your order is confirmed; each subsequent charge is made at 30-day intervals. Before each renewal charge we will email you (typically 3 days before the charge) so you can manage or cancel your membership.
Authorisation to charge. You authorise us (or our payment processor, on our behalf) to charge the payment method you provided at checkout, or your saved payment method (for example Shop Pay), for each renewal in accordance with this section. Renewal charges may appear on your card or bank statement under our Shopify Payments statement name, such as "LUTRISTY". If the renewal amount changes, we will tell you by email before the change takes effect.
Cancellation. You may cancel LTY Prime at any time. To cancel, email help@lutristy.com with your order number and a payment confirmation (for example a statement line or the confirmation email for a charge). Cancellation is effective at the end of the current Paid Period; your membership access continues until then. Cancellation requests must be made in writing; we cannot process cancellations by phone. Cancelling future renewals does not cancel an order already placed.
Agreement and record. By completing your purchase you agree to these Terms, including this LTY Prime section (enrolment, the US$39.99 renewal amount, the timing and frequency of charges, and the cancellation process above). We keep a timestamped record of your checkout as the record of your written agreement to these Terms.
4. Product information
Our rosemary and rice-water spray is a cosmetic hair-care product. It is not intended to diagnose, treat, cure or prevent any disease. Read the label and follow the instructions, ingredients and precautions supplied with the product. Product photographs and screen colours may differ slightly from the physical product, but this does not excuse a product that fails to match its description.
Promotions apply on the conditions stated with the offer at the time of purchase. Any introductory period, recurring price or membership condition is disclosed in this section before you buy.
5. Shipping and returns
Our Shipping Policy explains delivery options and our Returns and Refunds Policy explains cancellations, refunds and remedies. Nothing in these Terms limits a right you have under applicable law.
6. Using the website
Do not misuse the store, attempt unauthorised access to it, interfere with its operation or submit fraudulent orders. Our brand name, logos, product content and original text are protected by applicable intellectual property rights and may not be copied or used without our permission.
7. Changes to these Terms
Changes to these Terms apply to purchases made after the change. Existing orders remain subject to the Terms agreed when they were placed. Changes affecting an ongoing LTY Prime membership (including any change to the renewal amount) are notified to you by email before they take effect.
8. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses, and our total liability in connection with an order is limited to the amount you paid for the product or service giving rise to the claim. We do not exclude or limit liability where it cannot lawfully be excluded (including for death, personal injury, or fraud or fraudulent misrepresentation).
9. Governing law
These Terms are governed by the laws of the US state or territory where you reside. You may bring claims relating to them in the state or federal courts of that state or territory, and we may bring claims in the courts of your place of residence. This section does not stop you from bringing a claim in a court you are entitled to use under mandatory consumer protection law.
